The regulator turned odds into a compliance surface

A price is a piece of design. On 7 August 2026 the CFTC decided it is also a regulated statement, and the letter reaches well past the exchanges into everything sportsbook marketing publishes.

Quick answerOn 7 August 2026 the CFTC told prediction markets to stop showing prices in American odds format. Sportsbook marketing teams now own a compliance surface covering affiliate feeds, price widgets and paid creative.
Section 01

What the regulator actually said, and how far it reaches#

sportsbook marketing

The fox does not argue with the fence. It reads the field, finds the gap, and slips through before the farmer looks up. Marketing teams get the same choice this week, because a regulator has quietly turned a formatting convention into a compliance surface, and the scent of it runs through every asset sportsbook marketing publishes.

On 7 August 2026 the Division of Market Oversight and the Market Participants Division wrote to Commission-regulated entities involved in listing, soliciting or accepting event contracts. The CFTC told them to display clear and accurate pricing information for derivatives products, and to make it obvious to consumers that a product is an event contract on a CFTC-regulated exchange rather than a higher-margin, non-market-priced bookmaking product.

The specific quarry is the American odds format, the plus and minus prices any US bettor can parse at a glance. Staff called that presentation likely to mislead market participants about the nature of the transaction, and warned that misleading pricing risks breaching the federal prohibition on manipulative devices: Regulation 180.1, the same provision the Commission used in a settled event-contract manipulation case on 31 July 2026, as Foley and Lardner set out.

Here is the part most compliance summaries skimmed past. The letter is addressed to registered entities, intermediaries, affiliates and partners. Affiliates. Partners. In practice that phrase drags comparison tables, price widgets, syndicated feeds and agency creative inside the perimeter, which is why this is a sportsbook marketing problem before it is a legal one. The trail runs from the exchange to the smallest scraped table on the internet.

No stated deadline, which is harder, not easier#

The release itself sets no compliance date. Reporting by Bettors Insider on 8 August says Kalshi confirmed it would comply and Polymarket declined to comment, with the American odds format still visible on sports contracts at the time of writing. A missing date is not slack. It means the exposure starts now and accrues quietly.

A two-way market quoted at -110

Minus 110 says: stake 110 to win 100. It carries no statement of probability, no mention of an exchange, and no hint that you hold a contract you can sell before the event settles. It is bookmaker grammar, tuned over a decade to feel native and frictionless, and it is exactly the reading the CFTC now calls likely to mislead.

The same market quoted at 52 cents

Fifty-two cents says: the market prices this at roughly a 52 per cent chance, a winning contract settles at one dollar, and you can sell at any price in between. Polymarket's own help centre states the principle flatly, that prices are probabilities, in its note on how prices are calculated. Duller to read. Far harder to misunderstand.

That is the whole argument in two tabs. One presentation sells a payout, the other states a probability, and only one of them survives a regulator asking what the number means. For sportsbook marketing that is the entire brief, and it is a design brief, not a legal memo.

Section 02

Every asset that renders a price is now a regulated artefact#

Compliance teams tend to picture the product surface: the exchange, the app, the price board. Fine, and far too narrow. A price appears in dozens of places a brand does not own, and the letter's reach to affiliates and partners means each of those places carries the same burden as the venue itself. Sportsbook marketing owns far more of that estate than its org chart suggests.

What sportsbook marketing actually owns#

So the practical brief is an inventory problem before it is a design problem. You cannot fix what you have not found, and the assets most likely to breach are the ones nobody in the building can edit: an affiliate's comparison table, a vendor's syndicated widget, a stock creative pack an agency built in March and still serves in August. That is the burrow nobody thought to check.

Every surface that can render a contract price, who actually controls it, and what sportsbook marketing has to change under the CFTC letter of 7 August 2026.
Asset that shows a priceWho really controls itWhat has to change
Exchange price board and appThe venueCents or per cent, with the event-contract nature stated on the surface, not buried in terms
Affiliate comparison tablesThe affiliate, not youFeed schema and row template rewritten, or the partner quietly drops the market
Syndicated price widgetsA third-party data vendorA new render mode, versioned, with a fallback that fails to probability rather than to odds
Paid search and paid social creativeAgency and in-house studioEvery asset carrying an American odds format price pulled, re-cut and re-approved
Sponsorship and broadcast graphicsThe rights holderThe graphics package renegotiated, because the price renders on somebody else's screen
App store screenshots and push copyProduct and lifecycleStore assets resubmitted, push templates re-approved, old sends retired
Organic content and the blog archiveContent and SEOThe archive swept for odds tables, because a 2024 explainer still renders today

The Gambling Commission reached the same structural conclusion years ago in a different jurisdiction: licensees must advertise in a socially responsible manner and comply with the UK codes issued by the Committees of Advertising Practice, whoever physically made the asset. Britain's answer to sportsbook marketing done on your behalf has always been that it is still your marketing.

Anyone running iGaming marketing in a regulated market already knows the shape of this. What is new is the trigger. The old audit asked whether a claim was responsible. The new audit asks whether a number is honestly formatted, which is a question a designer answers rather than a lawyer, and it puts sportsbook marketing back in the room where the decision gets made.

Section 03

The conversion is arithmetic, so sportsbook marketing can show its working#

There is a comforting thing about this brief: nobody has to model anything. Converting the American odds format into implied probability is deterministic, it fits on a beer mat, and it means sportsbook marketing can check the compliance team's homework in ten seconds flat.

A minus price divides the stake by the stake plus 100. So -110 becomes 110 divided by 210, which is 0.5238, or 52.38 per cent. A plus price divides 100 by the price plus 100. So +150 becomes 100 divided by 250, which is 0.40, exactly 40 per cent. Two rules, no rounding tricks, no house view.

What four familiar prices actually claim
Bar chart converting four American odds format prices into implied probability: minus 110 is 52.38 per cent, plus 150 is 40 per cent, minus 200 is 66.67 per cent, plus 900 is 10 per cent-110: 52.4+150: 40-200: 66.7+900: 1066.7%50%33.3%16.7%0%-110+150-200+900
These figures are the standard arithmetic conversion of the American odds format into implied probability, shown for illustration only, and a useful sanity check for any sportsbook marketing team reviewing creative. They are not data drawn from the live book at any venue, and they exclude the margin built into a bookmaker's two-way price. Method: minus prices are stake divided by stake plus 100, plus prices are 100 divided by price plus 100. The plus-900 example follows the American odds format described by Bettors Insider.

Look at the fourth bar and the behavioural case writes itself. A price of +900 reads as a big bright number, a payout worth chasing. Ten per cent reads as what it is. The Behavioural Insights Team tested exactly that gap with the Ohio Casino Control Commission, across more than 4,000 US participants and five presentation formats, and found the American odds format alone produced significantly more risky picks.

Why the honest American odds format is also the clearer one#

The same trial found participants pricing a same-game parlay at a 53 per cent chance when the real probability was 4 per cent. That is not a rounding error, it is a comprehension failure baked into a display convention, and a related argument about the hundred-dollar anchor built into the American odds format runs through GamblingHarm.org.

For once the compliant option and the clear option are the same object. That is rare enough to be worth banking, because most compliance work in this sector trades comprehension for coverage. Here, sportsbook marketing gets to make a creative argument out of a regulatory instruction, which is a far better internal pitch than a mandated retreat.

It also changes what a landing page can do. A percentage invites a comparison, a payout invites a fantasy, and comparison is the friendlier ground for a brand that intends to still hold the account in three years. Teams doing serious content marketing should be quietly delighted: the honest number is easier to explain, easier to chart, and easier to cite.

Section 04

Prediction markets are buying the legitimacy furniture#

Now the tension worth the ticket price. In the same seven days that a regulator told event-contract venues not to look like sportsbooks, those venues carried on buying the exact furniture that makes a sportsbook look legitimate: official data, league intellectual property, stadium signage. Every one of those is a sportsbook marketing asset with a decade of precedent behind it.

Genius Sports signed Kalshi on 5 August 2026, one day after a comparable Polymarket agreement, according to Legal Sports Betting. The Kalshi deal covers the English Premier League, Serie A, Liga MX, the Argentine Primera Division and Ligue 1. The Polymarket deal adds exclusive US live streaming and league intellectual property for selected competitions. Neither side disclosed terms.

Genius Sports has new deals with Kalshi and Polymarket, so the data and settlement are now compliance surfaces.

Counted from the coverage lists in the reporting, because no financial terms were disclosed for any of the three agreements. SR is the Sportradar agreement with Kalshi of 8 June 2026, covering MLB, NHL, MLS and UFC; GS is Genius Sports, whose Polymarket deal took effect 4 August 2026 and whose Kalshi deal was announced 5 August 2026, per Legal Sports Betting. This charts named sport coverage, not deal value.

Read the shape rather than the size. Three official-data agreements in nine weeks is a category buying the settlement infrastructure and the integrity monitoring that regulated sportsbooks spent a decade acquiring. That is not a sportsbook marketing flourish, it is the plumbing that lets a contract settle without an argument, and it is the reason the branding is arriving so fast behind it.

For an incumbent operator the read is uncomfortable and useful. You now share a shelf with a competitor holding league intellectual property and stadium signage, and that competitor has just been told it may not use your visual language. A decade of sportsbook marketing built that language, and your rival is now barred from copying it, which is the strangest competitive moat this sector has produced in years. Treat it as one, and get the brand strategy work done before the novelty wears off and you are quietly outfoxed by a venue with a stadium behind it.

Section 05

The creative audit, and the map that punishes national campaigns#

Every regulated market eventually teaches marketers the same lesson: the efficient asset is the non-compliant one. National creative, one feed, one template, one glorious set of screenshots, is a cost saving right up to the moment a state or a division disagrees with a single frame. Sportsbook marketing has spent years optimising for reach, and reach is now the thing that carries the risk.

The creative audit, in the order that actually works
Inventory every render

List every surface that can display a contract price, including the ones a partner owns. Feeds, widgets, ads, store assets, broadcast graphics, old blog tables.

Sort by control

Mark each row with who can change it and how fast. Anything you cannot edit within a fortnight is your real risk register.

Fix the feed first

Feeds and widgets fan out through the hedgerow to hundreds of pages you will never see. Change the schema at source and most of the long tail fixes itself.

Re-cut the creative

Pull every paid asset carrying an American odds format price. Rebuild in probability, keep the visual system, change only the number.

Log the sign-off

Record who approved each change and when. The question after any incident is who signed it off, and nobody ever remembers.

Re-run it monthly

New markets, new partners and new creative arrive constantly. An audit run once is a snapshot, not a control.

Then look at the map, because paid media has already fragmented. Google's prediction markets policy permits US targeting excluding Michigan, Nevada, New York and Ohio. The July 2026 update added Michigan and New York from 13 July. Utah's ruling landed on 4 August. National sponsorship inventory now spends part of its budget in states where the ad cannot run.

Which policy bucket does an event contract sit in?#

This is the question that quietly costs accounts, because the platforms do not use one bucket. Google runs a gambling and games policy requiring country-specific certification and licence evidence, a separate financial products and services policy that bans binary options outright, and a third prediction markets policy that admits only designated contract markets and NFA-authorised brokerages.

Get the bucket wrong and the failure is not a disapproved ad, it is an account-level action against the advertiser, which is the single most expensive mistake in sportsbook marketing. Certify under gambling when the product is an event contract, or push event-contract creative that reads as a fixed-payout derivative, and you are arguing your case after the suspension rather than before it. Any competent PPC team should have that mapped in writing before the next flight goes live.

The regulatory direction of travel is visible too. In June 2026 the Commission proposed amendments to Regulation 40.11 and a new appendix covering event contracts that reference sporting events, per the CFTC, following the March advisory and rulemaking notice summarised by Norton Rose Fulbright. Enforcement has run alongside it, including the February prediction markets advisory from the Division of Enforcement.

The UK offers the useful contrast. Section 16 of the CAP Code polices the social responsibility of gambling advertising rather than the arithmetic of the price, so British teams have spent a decade auditing tone, targeting and appeal to under-18s. American teams now have to audit a number format as well, which is a genuinely new muscle for sportsbook marketing to build.

None of this needs a rebrand. It needs an inventory, a feed change, a re-cut, and a record that tracks who approved what. That is unglamorous work done back at the den rather than out on the ridge, and it is precisely the work that decides which brands are still trading in this category in 2028. If you want it built rather than described, that is what folkfox paid social and folkfox SEO and GEO services do, and the same discipline runs through our FinTech marketing practice, where a price has always been a regulated statement.

Questions

Frequently asked questions#

What did the CFTC actually tell prediction markets to do?

In a letter dated 7 August 2026, the Division of Market Oversight and the Market Participants Division told regulated entities to display clear and accurate pricing information for derivatives products, and to make clear the product is an event contract on a CFTC-regulated exchange rather than a bookmaking product. Staff said American odds format is likely to mislead market participants about the nature of the transaction.

Does the letter apply to affiliates and marketing partners?

Yes. The CFTC addressed it to Commission-regulated entities involved in listing, soliciting or accepting event contracts, and named registered entities, intermediaries, affiliates and partners. That wording pulls comparison tables, syndicated price widgets, affiliate feeds and agency creative inside scope, so sportsbook marketing owns a real share of the compliance work.

Is there a deadline for changing odds displays?

The press release states no compliance date. Reporting on 8 August said Kalshi confirmed it would comply and Polymarket declined to comment. Treat the absence of a date as exposure starting immediately rather than as breathing room, because there is no published grace period to point at afterwards.

How do you convert the American odds format into implied probability?

Two rules. For a minus price, divide the stake by the stake plus 100, so -110 becomes 110 divided by 210, or 52.38 per cent. For a plus price, divide 100 by the price plus 100, so +150 becomes 100 divided by 250, or 40 per cent. The conversion is arithmetic and ignores any bookmaker margin.

Does this change anything for a licensed US sportsbook?

Directly, no: the letter addresses CFTC-regulated event contract venues, not state-licensed sportsbooks. Competitively, yes. Prediction markets are acquiring official data feeds and league intellectual property while being told not to use sportsbook visual language, so the price format sportsbook marketing built is now something a rival cannot copy.

Can I still advertise prediction markets on Google?

Only as a CFTC-designated contract market or an NFA-authorised brokerage, with Google certification, targeting the United States excluding Michigan, Nevada, New York and Ohio. Michigan and New York were added on 13 July 2026. Binary options remain prohibited under the separate financial products policy.
