A MiCA licence is now a distribution asset, and Binance’s Greek file shows why

On 18 September 2026 CoinDesk reported, citing the Wall Street Journal, that Binance’s Greek application had been deemed complete and then stalled. Whatever the truth of the why, the what is plain: a MiCA licence has become the gate to Google ads, to passporting and to the one claim a rival cannot copy.

What the WSJ reported about a MiCA licence, and what nobody has confirmed#

The fox never mistakes a rustle in the hedgerow for the animal itself, so start with attribution. On 18 September 2026 CoinDesk reported that, according to the Wall Street Journal and people familiar with the process, ECB President Christine Lagarde intervened to stall Binance’s bid for a MiCA licence in Greece. CoinDesk’s summary says the reported worry was that Binance’s scale could deepen the use of dollar-based stablecoins in the EU, and that the reported delay was meant to last until ESMA takes over licensing under a proposed reform that has yet to be adopted.

The denials belong on the same panel as the claim, so here they are. A Binance spokesperson told CoinDesk, “We will not comment on speculation.” An ECB spokesperson declined to comment and said the ECB has no institutional role in authorising crypto-asset service providers, which sits with national authorities, in this case the Hellenic Capital Market Commission (HCMC). The Greek City Times, summarising the WSJ, reported that the HCMC said it assessed Binance’s application independently and exclusively against EU and Greek requirements, and that a Greek government adviser said the government had no role. Read together, that is a dispute, not a finding.

Now the part that is not in dispute. Binance withdrew the Greek filing in June: CoinDesk places it in mid-June, while Binance’s own post announcing the withdrawal is stamped 24 June 2026, so folkfox writes “June” and leaves the exact day to the record. And the rule that gives the whole episode its weight is plain law. Regulation (EU) 2023/1114 says in Article 59 that a person shall not provide crypto-asset services within the Union unless authorised as a crypto-asset service provider (CASP), or allowed to do so as a bank, investment firm or other listed entity.

You do not need to settle who telephoned whom to act on any of this. A growth lead needs only the second half of the sentence: whichever way the Greek file was decided, a MiCA licence decides who gets to sell, who gets to advertise and who gets to say so out loud. The rest of this piece is about that trail, and how to walk it when your own approval is still awaited.

Why a MiCA licence is now a distribution asset#

Legal teams file for a MiCA licence to be lawful. Growth teams should notice what it quietly switched on. Google’s Cryptocurrencies and related products policies allow ads for exchanges and software wallets in the EU only when the advertiser is authorised as a CASP under MiCA by a national competent authority, complies with any other local rules, and is certified by Google. Greece is on the list of targeted countries, alongside the other 26 EU member states.

The date matters. Google’s EU crypto advertising change log says the requirement took effect on 23 April 2025, posted on 24 March 2025, with country-based licences honoured only during each member state’s own transition: Finland until 30 June 2025, Germany until 30 December 2025 and France until 30 June 2026. France was the last to fall. Google’s note of 1 July 2026 says it stopped accepting the French DASP registration that day, so from July the only key in any of the three is a MiCA authorisation.

The perimeter keeps widening. On 22 July 2026 Google posted a further update opening exchange and wallet ads in Iceland, Liechtenstein and Norway from August 2026 on the same three conditions. The change log also promises a warning at least seven days before any account suspension. In plain fox terms: the ad account is now a checkpoint that reads the regulator’s list, and no amount of clever bidding outfoxes a checkpoint.

Passporting is the second half of the MiCA licence asset. Article 59(7) allows an authorised CASP to provide services throughout the Union, and Article 65 sets the notice route: tell the home authority which member states you intend to serve, and you may begin from the date it confirms, or at the latest the 15th calendar day after you file. One authorisation, one home regulator, a whole continent of paid search. Two caveats keep the scent clean. Google’s policy page lists hardware wallets as an exception to the authorised-provider test, though they still need Google’s certification and must not offer buying, selling or exchange. And an authorisation covers only the services named on it, so a wallet that quietly adds swaps has wandered off the trail. If the advertised product is a tokenisation platform, the first question is which of the MiCA service categories it actually performs, because that answer sets both the licence and the ad eligibility.

The clock that turned every CASP licence into a deadline#

Every hunt has a season, and MiCA’s was written into Article 143(3): firms providing services lawfully before 30 December 2024 could continue until 1 July 2026, or until they were granted or refused authorisation, whichever came first, and member states could shorten that. On 4 December 2025 ESMA’s statement on MiCA transitional measures told unauthorised CASPs to have orderly wind-down plans ready, and reminded national authorities to treat “last minute” applications with considerable caution.

A MiCA licence is therefore a queue with a hard edge, and the register shows the queue bunching against it. Counting entries in ESMA’s CASP file by their authorisation or notification date, folkfox finds 74 dated June 2026, the busiest month in the file, against 44 in December 2025 and just 8 in January 2026. That is a tally of our own from a file ESMA republishes weekly, so read it as a shape rather than a statistic, but the shape is hard to miss.

The statute’s own clocks explain why waiting is so expensive. Under Article 63, an authority acknowledges an application within five working days, checks completeness within 25 working days, and then has 40 working days from a complete application to adopt a reasoned decision. On paper that is 65 working days, roughly thirteen weeks, before any pause for missing information. How those clocks ran in Binance’s case is not public, which is exactly why the reported version deserves attribution, not adoption.

Home authorities differ in experience, too. The EY Greece law alert records that the HCMC issued Decision 8/1059 on the CASP authorisation procedure under Law 5193/2025, and Capital Wallet Greece’s own release says it was granted one of the country’s first CASP authorisations on 27 July 2026. Choosing a home state is a growth decision as much as a legal one, because it sets how fast the door opens and how much precedent the authority already holds.

Set the sentence against the marketing map. Under Google’s published test, an exchange without a CASP authorisation is not eligible to advertise in the EU states it lists, and without an authorisation there is no passport to use. That is what waiting for a MiCA licence costs: a quiet closing of channels, with no fine in sight. CoinDesk reported that Binance began winding down operations after withdrawing the Greek filing, and Lynch told CoinDesk the exchange had been “deemed to have a complete application.” Those are Binance-side and reporter-side accounts; the HCMC’s stated position is the independent assessment quoted above.

The regulator that grants your licence may also change. The European Commission’s December 2025 package proposed moving direct supervision of certain significant infrastructures and crypto-asset service providers to the EU level, and ESMA’s welcome of that proposal says as much. CoinDesk’s report describes the reform as not yet adopted. For a growth plan, the takeaway is dull and useful: keep the file current, keep the paperwork portable, and expect two audiences, the national authority now and ESMA later.

On the record, the policy worry is not hidden. In a speech on 8 May 2026, Christine Lagarde said stablecoins have grown from under USD 10 billion six years ago to more than USD 300 billion, are overwhelmingly denominated in US dollars, and that nearly 90% of the market is controlled by two issuers. The speech does not mention Binance, and folkfox draws no line between the two; it simply shows why a stablecoin-heavy exchange sits in a moonlit corner of European policy debate.

The American contrast is instructive. On 15 September 2026 the Senate’s roll call vote 234 on cloture on the motion to proceed to H.R. 3633, the digital commodities market-structure bill, was rejected 49 to 50 with one senator not voting, where three-fifths were required. The vote leaves that federal rulebook unwritten for now. In the EU the rulebook exists, the register is public, and the answer to a Google account manager is a lookup.

Where the licences sit: the register, state by state#

ESMA’s interim MiCA register is the list an ad reviewer, a journalist and a suspicious customer can all open. ESMA says it publishes the register weekly, that national information may not appear immediately, and that a withdrawn authorisation stays in the file with its end date. Its latest update on the page is dated 16 September 2026. Downloading the CASP file on 19 September, folkfox counts 347 entries without an end date, up from the roughly 320 folkfox counted on 8 August, allowing for differences in method.

Where those entries live is the plot. Germany accounts for 91, more than a quarter of the total, and the top five home states (Germany, France, the Netherlands, Cyprus and Malta) account for 200, or about 58%. Greece has none listed as a home state in the file, even though Capital Wallet Greece said it was authorised on 27 July. The likeliest explanation is the weekly lag ESMA itself warns about, and the case for reading a register as a snapshot, never a verdict.

Read the chart as a growth planner, not a lawyer. Germany’s count is padded by banks and brokers, with Commerzbank, N26 and Trade Republic among its entries, which is why it towers; Cyprus and Malta are where several pure-play exchanges chose to stand. A MiCA licence’s home state is also a brand backstory: “authorised in Malta” and “authorised in Germany” invite different follow-up questions, and the register lets a sceptical buyer ask them.

How to market while your MiCA crypto application is pending#

Start with the rule that protects a MiCA licence claim. Article 59(5) says a person who is not a CASP shall not use a name, or a corporate name, or issue marketing communications, suggesting it is a CASP or likely to create confusion in that respect. Read that beside “MiCA-ready” or “fully MiCA-compliant” copy on a pre-approval landing page, and the vulnerable phrase is obvious. This desk is marketing, not counsel, so take legal advice on every claim; the direction of travel is still clear.

That second version is longer and duller, and it is the one a regulator, a journalist and an ad reviewer cannot fault. It also builds the asset you will need the day approval lands: an audience already waiting for the announcement. A poised waiting list is worth more than a burst of pre-approval clicks that the ad platform would have refused anyway.

Plan the launch, not the hope

Line up creative, landing pages and a passporting rollout by member state, so the first week after approval is not spent briefing agencies.

What a pending applicant can run is broader than it feels. Brand and education content, technical explainers, hardware-wallet campaigns that genuinely meet Google’s definition, and markets outside the EEA under their own rules all remain open subject to local law. What is closed is the Google search checkpoint for an exchange or software wallet in the EEA.
